Terms of Service

1. Scope

These Terms of Service govern the use of the "rechoice" platform (hereinafter "Platform"), operated by [FIRMENNAME], [STRASSE HAUSNUMMER], [PLZ ORT] (hereinafter "Operator"). By registering for or using the Platform, you accept these Terms.

2. Account Creation

Certain features require creating a user account. You must be at least 16 years old to create an account. To access content rated 18+, you must be at least 18 years old. You are obligated to provide truthful information and to keep your credentials confidential. Each person may only create one account. The Operator reserves the right to suspend or delete accounts that violate these Terms.

3. Acceptable Use

The Platform may only be used for lawful purposes. In particular, the following is prohibited:

  • Creating, uploading, or distributing illegal content
  • Publishing hate speech, discrimination, or incitement to violence
  • Distributing content that violates applicable law
  • Using the Platform in a way that impairs its operation or other users
  • Using automated access (bots, scrapers) without the Operator's explicit permission

The Operator reserves the right to remove content and suspend accounts that violate these provisions.

Content Moderation

Users can report content that violates these provisions via the Platform's report function or by email to copyright@rechoice.app. The Operator reviews reported content and decides on appropriate measures within 7 business days. Possible measures include making content inaccessible (suspension of Store listing and/or hosting), suspension of publishing rights, or deletion of the account. Suspended content remains visible to the author in their account and may be resubmitted for approval after modification.

Affected authors will be notified of the measure taken by email and may respond within 14 days. The suspension or removal of content does not give rise to any claims by the author for compensation, lost revenue, or refund of fees.

4. Intellectual Property

Authors retain all rights to the content they create (stories, text, images). By uploading content to the Platform, authors grant the Operator a simple, revocable license to display and distribute the content within the Platform. This license expires when the author deletes the content or their account.

The Platform itself, including its design, code, and trademarks, is the intellectual property of the Operator.

Embedded Media

Authors may embed external media (images, audio) via URLs in their projects. The author is solely responsible for ensuring they hold the necessary rights to use and publish such media. This applies in particular to media embedded via direct links (hotlinks) from third-party servers.

The Operator assumes no liability for copyright infringement through user-generated content. Upon receiving substantiated reports of rights violations (Notice & Takedown), the affected content will be suspended without delay. Rights holders may report violations via the reporting function or by email to copyright@rechoice.app.

Permitted: own media, media under free licenses (e.g. Creative Commons, CC0, Public Domain), and media for which explicit permission has been granted. Embedding copyrighted third-party media without permission is prohibited.

Fan Fiction & Derivative Works

Publishing fan fiction or derivative works on the platform is only permitted under the following conditions:

  • The source material is in the public domain, or
  • the author holds an explicit license or permission from the rights holder.

Publishing or selling fan fiction based on protected intellectual properties (e.g. Harry Potter, Star Wars, Marvel, etc.) without permission from the rights holder is not permitted. The Operator reserves the right to remove such content without prior notice. Repeated violations may result in account suspension.

5. Marketplace

Authors can distribute their stories through the integrated store. The following conditions apply:

  • Platform fees: Users on the free plan (Free) are subject to a 20% platform fee on sales. Users on the Pro plan are subject to a 10% platform fee.
  • Pricing: Authors may use the "Pay What You Want" (PWYW) model or set fixed prices. All prices on the Platform are quoted in US Dollars (USD). Displayed prices may be subject to applicable taxes.
  • Store rules: All content offered in the store must comply with the Acceptable Use policy (Section 3). The Operator reserves the right to remove content from the store that violates these rules.
  • Payouts: The author's share (sale price minus platform fee) is credited to the author. Payouts are processed via the payout method provided by the Operator. Details on payout schedules and minimum thresholds are communicated in the account section of the Platform.

6. Hosting

In addition to publishing in the Store, authors can also host their stories through the Platform. Hosted content is served as versioned snapshots. Changes to the project only become visible on the hosted version after republishing. The Operator reserves the right to remove hosted content that violates the Acceptable Use policy (Section 3).

Free Hosting

  • Hosted content displays a rechoice badge
  • Publishing to the Store is required
  • Content is served under a Platform URL (e.g. rechoice.app/play/name)

Hosting Plus

  • The rechoice badge can be removed
  • Custom branding (logo) is available
  • Store publishing is not required
  • Content is additionally served under a dedicated subdomain (e.g. name.rechoice.app)

7. Advertising

The Platform may display advertisements, particularly in the Reader when reading and playing stories. Users on the free plan (Free) see ads when reading stories that they have not created or purchased themselves.

Users with an active Reader Premium or Author Pro subscription, as well as users who have purchased a story, do not see ads. The Operator reserves the right to adjust the type, scope, and placement of advertising at any time.

8. Subscriptions

Paid subscriptions are processed via Stripe. The Platform offers various subscription plans whose respective features can be viewed on the Platform's pricing page. The Operator reserves the right to modify the feature scope of individual plans. The following conditions apply:

  • Subscriptions renew automatically at the end of each billing period.
  • Cancellation is possible at any time and takes effect at the end of the current billing period.
  • After cancellation, subscription features remain active until the end of the paid period.
  • No pro-rata refunds are provided for already paid periods.

9. Right of Withdrawal

As a consumer in the European Union, you generally have a 14-day right of withdrawal. For digital content (story purchases) that is made available immediately after purchase, you expressly agree during the purchase process that delivery begins immediately and acknowledge that you thereby lose your right of withdrawal.

For subscriptions, the right of withdrawal applies within 14 days of entering into the contract. Withdrawal can be declared via email to support@rechoice.app. Time already used will be charged proportionally.

10. Limitation of Liability

The Platform is provided "as is." The Operator is not liable for damages arising from the use of the Platform unless caused by intentional or grossly negligent conduct. Liability for slight negligence is limited to the breach of material contractual obligations (cardinal obligations).

The Operator is not liable for content created by users. User-generated content is the sole responsibility of the respective author.

11. Data Backup

The Operator endeavors to securely store all data but does not guarantee against data loss. Authors are responsible for regularly creating backups of their content (e.g. using the JSON export, which is available free of charge on all plans). The Operator is not liable for loss of content due to technical failures, server outages, or force majeure.

12. Availability

The Operator strives to ensure high availability of the Platform but does not guarantee uninterrupted access. This applies to all Platform services, including the Store, Hosting, and Reader. No Service Level Agreement (SLA) is provided. Planned maintenance will be announced in advance when possible.

Temporary or permanent outages, technical issues, or limited availability of the Platform do not give rise to any claims for compensation, fee reduction, or refund of subscription fees.

13. Changes to Terms

The Operator reserves the right to modify these Terms. Changes will be communicated to users at least 30 days before taking effect, via email or through the Platform. If a user does not object within 30 days of notification, the new Terms are considered accepted. In case of objection, the user has the right to terminate their account.

14. Account Termination

Users may delete their account at any time through their account settings. The Operator may suspend or delete accounts that violate these Terms. After deletion, personal data will be handled in accordance with the Privacy Policy.

15. Final Provisions

  • German law applies.
  • Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected (severability clause).
  • The place of jurisdiction is, to the extent permitted by law, the registered office of the Operator.
